The nursing home in São Francisco do Sul, in the north of Santa Catarina, received an order from the judge of the 2nd Civil Court of the District of São Francisco do Sul, João Carlos Franco, to pay compensation for moral damages to the family of the Old Man.

This is because, according to the family’s request and the magistrate’s analysis, the nursing home did not properly care for the ex-prisoner. He was dehydrated, had wounds all over his body, and died a few days later.
The lawsuit states that the daughter, claiming it was impossible to maintain her father’s quality of life as he was also in poor condition, signed a contract with the institution in November 2020.
However, ten days after hospitalization, an elderly man, already at an advanced age, suffering from Alzheimer’s and Parkinson’s disease, showed dehydration, lost ten kilograms and was hospitalized when doctors discovered the presence of small bedsores.
After being discharged from the hospital, the elderly person returned to the care of the rest home, and management of the management of trauma care was transferred to the owner of the institution.
The daughter of an elderly man said that she did not stay long without visiting her father due to the restrictions associated with the pandemic. However, when he received permission, he was startled by the appearance of his father, who was very thin, with an expression of pain and a few bruises.
On the same day, the elderly man was again sent to the hospital when wounds in a neglected state were found all over his body, reaching a depth and width of 7 centimeters. In March 2021, he died.
“The recognition that there was a failure in the services provided by the defendant, as a result of which proper care was not provided for the elderly placed in her care, cannot be rejected. The responsibility of the defendant in this case is objective, and requests for the absence of guilt in what happened are unfounded,” the justice of the peace noted in his decision.
