In Indaiala, in the Itajai Valley, a man was sentenced to 62 years and two months in prison for raping a vulnerable woman on two of his stepdaughters. The crimes were committed from 2014 to 2020. At the time of the beginning of the rapes, one of the girls was four years old, the other was seven years old. The defendant was also ordered to pay 15,000 reais to each of the victims in damages. The verdict was announced on Tuesday (4).

Since the stepfather committed crimes against his stepdaughters, in the context of domestic and family violence, the number of rapes of the vulnerable increased, as defined by article 226 of the Criminal Code. Another circumstance that led to the toughening of the sentence was the fact that the crimes were committed continuously, countless times over the years.

Thus, for each of the victims, he was sentenced to 31 years and one month in prison with a closed initial regime, for a total of 62 years and two months. The defendant, who was already in the pre-trial detention center, was denied the right to appeal against the verdict. The decision is still subject to appeal.

According to the complaint of the 1st Prosecutor’s Office of Indaiala, the crimes began in 2014 and continued until mid-2020, being committed in the house where the convict, his partner – the mother of the victims – and children lived.

One of the victims was already 10 and the other 13 when the facts became known to the authorities because of their fear of their stepfather. The defendant took advantage of the moments when he was alone with the girls and forced them to have sex with him, continuing to rape them incessantly.

Sexual intercourse or any indecent act before the age of 14 is considered rape of a vulnerable person. This is a heinous crime with no bail. The law provides for punishment for this crime from eight to fifteen years in prison. However, child sexual abuse committed within the family is punished by Brazilian law in the most severe manner.
