One of the companies that could participate in the auction filed a precautionary measure requesting a suspension following the discovery of possible irregularities in a public notice that was scheduled to open bids last Monday (30).

The company argues that the public notice prevents the administration of the service from submitting a negative rate and that, as a result, all offers will be equivalent to a 0% rate, which will jeopardize competitiveness, in addition to finding the best deal for the counterparty.

The contestant also argued that the conflict resolution criterion provided in the public notice, which requires the submission of an accredited network by interested parties, is not appropriate, which is not a criterion prescribed by law, according to the company submitting the request. .

In this regard, rapporteur Kléber Muniz Gavi determined the suspension of the public notice. “It is worth recognizing the plausibility of the representative’s statements, since the questioned conditions, in addition to hindering the bidding, violate the competitiveness of the tender and do not guarantee the search for the most profitable offer for the Company,” he decided.

The speaker gave the company’s CEO five days to prove to TCE that he had taken the necessary steps related to the suspension.

Companhia Águas de Joinville notes that “the bidding process has been prepared following a provisional measure that vetoes the application of a negative rate for food stamps and food stamps.”

He added that “at first, the Accounts Chamber, in order to better understand the situation, ordered to suspend the process. CAJ has not yet received a decision, which will be reviewed internally for further review by the Court.”
