About 50 people claiming to be buyers staged an invasion of private property on Rua Avelino Bernardi in Camboriu, north coast of Santa Catarina, last Saturday morning (9). The military police were called around 7 am.
According to the military police, it was discovered at the scene that several plots of land were already demarcated by zebra stripes and that some 50 people occupied part of these demarcated lands.
The “buyers” told police that they purchased the land in 2019 from a construction company, but the entire condominium planned for the project was embargoed by a court order. As a result, buyers banded together and demanded legal compensation for damages.
However, since they had so far failed to resolve the conflict legally, the residents met with other disgruntled buyers and decided to “take possession of their lands” by invading.
No representatives of the construction company have yet arrived at the scene of the incident. The police have informed the municipal authorities and Fucam (Camboriu Environmental Foundation), the department of social assistance and works, is on the spot.
The invasion zone is a permanent reserve
Junior Mafra, President of Fucam, explained no date+ who, along with other municipal representatives, was called to the site to analyze whether the captured territory was public or private, and it turned out that it was private territory. Municipal authorities were called around 8 am, but the occupation occurred very early, early in the morning.
The work has been embargoed since 2015 because it is located in an APP (permanent conservation area). The project was carried out when it was identified in an area of evidence, which they carried out in a permanent conservation area.
“Then there was interference, including from the prosecutor’s office, in this area. As a result, this area has remained at an impasse and is being discussed at the judicial level between the company and the judiciary. And since then this area has been closed,” explains Junior.
Also, according to the secretary, during conversations with these customers, they tried to understand the meaning of the lesson. “However, the statements are contradictory. There are people who have houses here in Camboriu, even for rent, but they exist, they live, they work, but they feel that they have the right to invade land, private territory, declaring their right to housing,” emphasizes Junior . .
Others claim that they bought the land from the invader, but did not provide any documentation, receipt, pre-sale agreement and are demarcating plots and building tents.
However, according to Fucam, no buildings are being built. The Municipality of Camboriu was then monitored in this regard. Avoid improper division of land, irregular occupation of territory, and non-standard buildings. Occupation of a permanent protected area.
“We are trying to look at the issue of sanitary supervision, the unsanitary situation there, who cooks there and fulfills their physiological needs. There is also the issue of a guardianship council for children and adolescents living in the area. Therefore, we, as a government body, monitor in this sense,” emphasizes Junior.
However, according to Fucam’s president, the owner must file a repossession application, which was already done on Saturday (9), in addition to the police report.
It is pending before a judge. A lawyer for a construction company based in Blumenau travels to Camboriu to try to hold a hearing with a judge in an attempt to evict people from the land. City Hall continues to monitor.
