The result is the result of a public civil lawsuit filed in 2019 by the municipality of Palos, led by then mayor and current state deputy Camilo Martins (Podemos), in which the company Arteris, the concessionaire responsible for the work, was accused of taking traffic relief measures. chaos throughout the city.region.

The Federal Court accepted the claim, which at that time called for the completion of work on time and the construction of a third lane on the section of BR-101 between Palosa and Biguaçu through a TAC (Term of Conduct Adjustment). signed between all parties.

The third strip was handed over, despite the fact that it covered the area between Palos and São José. The road outline, while not anything new, has a deadline of July 2024, but there is still no specific date.

According to ANTT’s (National Land Transport Agency) forecast for the second half of next year, the concessionaire is required to pay a daily fine in addition to being able to open the gate at the toll plaza located in Palos.

The Federal Court is still awaiting a response from Arteris Litoral Sul and, according to the ND Group report, such a position has not yet been taken by the concessionaire.

The municipality of Palos suffered the most due to the almost 12-year delay in the completion of the road outline. Since the southern section (all of Palos) is delayed the most, it is the city that has faced the inconvenience caused by what is considered the “largest” work underway in Brazil.

In August 2023, anticipating a delay that was confirmed two months later, the City Hall of Palosa submitted a petition to the 4th Federal Court of Florianópolis, as part of the 2019 public civil action, asking for an urgent hearing to discuss the application of fines. .

According to a decision by Federal Judge Wilian Bollman in a public civil action, the fine was set at five thousand times the basic fare applicable at the concessionaire’s toll plazas. Currently the cost is 4.90 reais, and with this sanction the cost is approaching 25 thousand reais per day.

Another punishment provided for in the decision is the opening of the company gates. The tendency is that if the punishment is confirmed, “only” in Palos Square will the matter be discussed.

“Only those who live in the reality of the city will understand the pain of the people. There is no point in those who are in Brasília, in ANTT, these considerations have no meaning for those who live in this situation, it is the impact of a delay in work that has been going on for four, five years,” noted the mayor of Palos, Eduardo Frecchia (Podemos ).

Negligent dealership

In addition to all the delays at Arteris Litoral Sul, there is a situation related to the helplessness of the company in Palos. Because of the urgency, we went there and did the work ourselves,” explained the CEO, who, when asked about the new deadlines promised by the company, objectively stated: “I don’t believe in it.”

“The damage done to Palos is immeasurable. Not only because of the inconvenience caused by the delay and how much it affects traffic flow, but also because of how much this chaos alienates companies from our city,” said MP Camilo Martins.
