The reason for the suspension, according to TCE/SC, is the lack of a detailed budget and the requirement that the winning company’s landfill be located no more than 50 km from the municipality’s headquarters, which limits the competitiveness of the bidding.
The precautionary measure was signed by Deputy Councilor Kleber Muniz Gavi and published in the official electronic gazette of TCE/SC last Tuesday (10). The document also specifies that failure to comply with the decision may result in a fine and gives the mayor 30 days to provide reasons, correct or cancel the notice.
Relevant non-conformities
According to the speaker in the case, there are significant inconsistencies during the auction that could affect the legality and economics of the contract. One of them is the lack of budget details.
According to the deputy councilor, the mayor’s office used the average value of the historical series for the period from January to July 2023 to calculate the maximum annual contract value.
“The use of historical series limited to only the first half of the current year does not show the best indicator, as it can cause distortions in the calculation of average monthly tons by ignoring the influence of seasonality in the last months of the year,” Gavi commented.
For the consultant, the notice does not clearly state the budget detailed in spreadsheets showing the unit composition of all costs for services provided, nor the methodology used to arrive at the values. “This means a condition that creates a potential risk of damage to the treasury,” he said, justifying the precaution.
About the location of the landfill
Regarding the location of the sanitary waste dump at a maximum distance of 50 km from the headquarters, the rapporteur noted that studies carried out by auditors of the Department of Bidding and Contracts revealed the presence of sanitary waste dumps in the region, located approximately 15 km, in Pescaria. Brava, 55 km in Ichar and 64 km in Urussang.
