Prosecutors succeeded in defending in court the hospitalization of a teenager suspected of threatening to attack a school in Poço Redondo, in Alto Vale do Itajaí, in April this year. According to the deputy, the protection of the minor even appealed against this decision, but the request was rejected.

According to the prosecution, the young man is suspected of committing a crime similar to the threat crime. The arrest of the minor was authorized by the prosecutor’s office on April 10 this year.
The prosecutor’s submission was upheld by the judge of the 1st Pozo Redondo Court, but the defense filed a new appeal with the TJSC (Santa Catarina Court) for a lighter sentence.
However, the 3rd Criminal Chamber of the Court analyzed the appeal and unanimously rejected the motion of his defence. Thus, the teenager must remain in the hospital and may serve a sentence of up to three years in a particular host institution.
“Such threats were specific and sufficient to cause intense fear and despair among the participants. An example of this is the teacher’s reports in the sense that the students who were threatened came to her in tears, showing real panic because of the speeches of the teenager,” prosecutor José Geraldo Rossi da Silva Cecchini supported in the latest accusations.
‘The teenager was fully aware,’ says judge
The verdict was passed on August 15, but the deputy announced it only on Monday (28). According to the rapporteur on appeal, the actions allegedly committed by the young man were extremely serious.
“The teenager was fully aware of all the consequences that such a promise could cause, and he made it again, realizing that this would cause a huge panic in schools in general. Therefore, there is no doubt that the teenager acted with malicious intent and with the specific purpose of causing fear and fear, ”the judge is quoted as saying.
Social and educational measure of hospitalization – up to three years. However, according to the ECA (Children and Adolescents Act), the content of the hospitalization must be reviewed every six months in accordance with the terms of the compatible violation with which he is charged.
