According to the prosecution, the defendant is also responding to a criminal case in which the MPSC is requesting that he be convicted under the provisions of article 32, caput, c/c, 1A and 2 of the Environmental Crimes Act, for abuse. to animals, with the aggravating circumstance that the crime was committed against dogs and cats.
Punishment – imprisonment for a term of two to five years, in addition to a fine and prohibition of detention. This lawsuit has already been accepted by the court and is awaiting sentencing.

The facts that prompted the deputy to file a lawsuit on October 11 took place between January 20 and 21, 2020. and in the garden of his own house, located in the Jarivatuba area, in the south of Joinville.
According to the ACP, he acted in this way because he sought to kill as many of the animals that inhabited the region as possible. While distributing poisoned food, the smell of the food attracted 27 cats and two dogs. After eating pieces of chicken and sausage, 25 cats and one dog died.

Innocent animals were exterminated and packed in bags. Also, with this criminal act, the man caused sadness among caregivers who love their animals as family members, as well as in a society shocked by such cruelty.
Even in the lawsuit, the prosecutor emphasizes that “in addition to environmental damage, which was characterized by a negative impact on the ecosystem and the consequences of the death of people, there was also damage to animals resulting from cruelty to animals, individually, intelligent beings capable of experiencing feelings such as pain and suffering. The deaths also caused a resonance and social shock in society. In this regard, responsibility for social damage is necessary.
Thus, the 21st Trial Chamber requires that the defendant, if convicted, pay compensation for damages in the total amount of 97,000 reais, i.e. 5,000 reais for environmental damage, 87,000 reais for damage to animals (3,000 reais per animal ) and R $5 thousand for social damage.
