Justice has determined this Thursday (13) that Apple will have to deliver a charger to anyone who bought an iPhone model without an accessory in Brazil. According to the decision of the 18th Civil Court of São Paulo, the technology company was also fined 100 million reais.
Apple will be required to deliver 20W, 35W, 67W, 96W, or 140W USB-C chargers to all affected Brazilian consumers. iPhone owners must physically present their device or an appropriate invoice for a mobile phone or something more affordable to the consumer to prove they purchased the products after October 13, 2020.
Judge Karamuru Francisco’s decision used the argument that selling cell phones without a charger was abusive and amounted to “selling a marriage upside down”.
“As for social losses, they are, as the defendant deliberately and deliberately sought to create this circumstance, justifying the “green initiative”, to harm its consumers,” he added. The decision can be appealed.
In September, the Ministry of Justice had already imposed a fine of 12.2 million reais for the same reason and suspended sales of this model.
The Court of TJ-SP (Court of Sao Paulo) determined on the basis of the verdict that it only sells its telephone sets of all models sold by it in the country, provided that with the assignment of the corresponding power adapters to its new customers.
