The possible participation of the mayor in the scheme was established during the procedural investigation of the complaint about the prosecution of five defendants. The lawsuit was added by the Deputy Attorney General for Legal Affairs of the MPSC and passed unanimously by the 2nd Criminal Chamber of the TJSC (Court of Santa Catarina).

Since the mayor has jurisdiction by virtue of the prerogative of the functions and the possible crime occurred in the office, the case must be heard by the Court as defined by the Federal Constitution. Thus, the MPSC amended the first degree complaint to include Sadi Inácio Bonamigo as an accused of fraud in the bidding process.

The court session took place on Tuesday (14) with the oral support of the prosecutor Rui Arnaud Richter. According to the MPSC, the mayor would try to prevent receiving a complaint about the infringement of the natural affairs patron; the absence of an addition to the complaint due to the lack of a description of the intent; and lack of compelling grounds for initiating criminal proceedings. However, the MPSC demonstrated that none of the allegations were substantiated and the complaint passed unanimously.

A criminal case has now been opened to guarantee a trial. Initially, the mayor will be called to answer the accusation and perform other legal proceedings until agreement (decision).

According to the investigators, in order to set the price significantly higher than the market price, the defendants included in the budget all the auction positions with an overpriced price. A dose of Holstein semen would have been purchased, for example, from the defendant’s company, with an overpricing of 486% compared to the price accepted in the municipality of Palma Sola, and 269% in the case of the municipality of Dionisio Cerqueira. .

Similarly, the Jersey semen would have been sold by the company to the municipality of Descanso at an inflated price, which reached 381% compared to the price practiced in the municipality of Palma Sola, and 183% if this comparison is made with the municipality. Dionisio Cerqueira.

What does the defense say?

According to the mayor’s lawyer, João Carlos Dalmagro Jr., the trial is being conducted under judicial secrecy and the mayor’s defense will only be carried out on a dossier, an opportunity in which, according to the lawyer, it will be demonstrated that he did not commit any crime.
