The MPSC (Ministry of State of Santa Catarina), through the 22nd Attorney’s Office of the Metropolitan District, is appealing the decision of the Santa Catarina Court, which suspended this Thursday (25th) the demolition of two houses built on Naufragados Beach, in the southern area of ​​Florianopolis. The Agency confirms the illegality of the construction of unauthorized buildings in the protected recreation area.

The Ministry of Defense emphasizes that the sentences that determined the demolition of buildings were issued in 2007 and 2008 and have already become final, that is, they have become final and are no longer subject to appeal.

The decision to stay the demolition was issued urgently by the duty judge, Julio César Knoll, pending a final decision on the petition for reconsideration. There is no time limit for the MPSC appeal.

After the measure taken by the judge became known, Florianopolis City Hall informed BUT+ that the municipality was called upon to abide by the decision and that it would not take a stand on the matter. “We have an obligation to uphold what defines justice,” he repeats.

The task force that was trained to carry out the demolition consisted of justice officials from the judiciary and the Municipal Planning and Urban Development Secretariat. They were supported by the Environmental Military Police, Floram and the IMA (Institute for the Environment) of Santa Catarina.

Residents celebrated the suspension

Residents are recording moments that anticipate the suspension of the demolition earlier in the day this Thursday. A worker with a sledgehammer even entered one of the houses to start felling, and the resident asked to stop. They then released videos of the TJSC (Santa Catarina Court) decision.

On the morning of this Friday (26), new videos circulated on social networks. Rama Florencio, the son of the resident who wanted to demolish the house, showed images of the situation at the site with materials and personal belongings outside the property.

“Now I’m calmer. We can put everything in its place. To the people who supported us, blessings for you,” said the elderly woman.

“Yesterday [quinta-feira] we are in a very difficult situation. Thank God my mother’s house is still standing. We have managed to turn our situation around. We just have to thank everyone who was touched and joined the fight for the community. We managed to win the battle, but the war continues,” Rama said.

After nearly 20 years of legal turmoil, the demolition of the three houses was scheduled to take place on Thursday morning. The action came from the MPSC and the task force had to implement the decision.

According to the MPSC, residents have already been notified of the spontaneous vacating and demolition of property, but they have not done so.

Also, according to the agency, when the actions began, the place where the houses were built was part of the territory of the Serra do Tabuleiro State Park. However, in the course of the process, there were changes in state legislation, and the site was transformed into a state conservation unit called the “Coastal Environmental Protection Zone”.

The Ministry of Defense explained that, despite the change, the situation with illegal buildings remains. This is because they were held in a permanent protected recreation area without any permission. In addition, under federal law and the Florianopolis Master Plan, no buildings are allowed on the site.

One of the three buildings was demolished, while the demolition of the other two was put on hold following a court decision in the afternoon.
