Residents of two underground buildings in the Masisso da Costeira Municipal Natural Park in Florianopolis must vacate them within 60 days. “Preliminary injunctions were issued on public civil lawsuits filed by the 22nd District Prosecutor’s Office of the Capital District. In its actions, the public ministry seeks the return of the occupied territories to the municipality of Florianopolis, the demolition of secret buildings, the payment of compensation and the restoration of the environment on the ground,” the deputy said.

According to public prosecutor Felipe Martins de Azevedo, the two houses were built on an extension to Via Professora Leonor de Barros in the Pantanal area after the creation of a natural park. A conservation unit does not allow private buildings within its boundaries.

“The place where illegal and secret structures were built is in the public domain, as it is located inside a fully guarded conservation facility, which requires the seizure of municipal property with the immediate eviction of property by its residents, removing the inevitable risk of the possibility of new illegal buildings on the site by the defendants or third parties. persons, if the possibility of maintaining the unlawful detention of a public place in the course of the action is fixed, which should take several years to come to a final decision,” the prosecutor explained.

The residents were even sued by Floram (Florianópolis Municipal Environment Fund), and Celesc cut off the electricity. However, secret communications have been redone, and no action has been taken by the government at the administrative level to demolish the houses from the site and restore the environment, according to IGCC.

The preliminary injunction issued by the 3rd Court of the State Treasury of the Florianopolis Judicial District determines that “the defendants must voluntarily leave the property within a maximum and non-renewable period of 60 days, under pain of being compelled to do so by the bailiff and, if necessary, by the police” .

The decision also requires Celesc to inspect the property, turn off any illegal electrical connections, and suspend new connections to supply electricity to the property. The preliminary injunction is subject to appeal.
