The case of an 11-year-old girl who became pregnant after she was a victim of rape was brought by a Santa Catarina judge. The pregnancy ended on June 22. The claim was confirmed by the TJSC (Santa Catarina Court).

According to the agency, the application considers that the case is closed in the court in which the lawsuit was considered. TJSC did not provide further details as it was a process in secret from justice.

The girl had a legal abortion at the 29th week of pregnancy on the recommendation issued by the MPF (Federal Public Ministry) Polidoro Hernani de San Tiago University Hospital, HU UFSC (Federal University of Santa Catarina).

The case came to light thanks to a report published in mid-June by The Intercept Brasil and Portal Catarinas. An 11-year-old girl became pregnant after being raped.

The child, then ten years old, discovered the pregnancy at the 22nd week of pregnancy. Her mother took her to Florianopolis University Hospital for a legal abortion.

However, HU refused to have an abortion, which is legally permitted in cases of sexual assault. The court did not give permission to terminate the pregnancy and sent the girl to a shelter.

She stayed in the shelter for more than a month until the court ruled that she could leave the shelter and return to her mother. Following the discovery of the case, the MPF recommended that HU carry out the procedure.

An investigation by the civil police of Santa Catarina showed that the suspect in the rape of the girl is a teenager close to her, a minor.

Judge Joana Ribeiro Zimmer, who authorized the girl’s hospitalization, closed the case. She was promoted to Comarca de Brusque in the Itajai Valley. The Department of Internal Affairs of the TAJ is investigating the actions of the judge.

Prosecutor Mirela Dutra Alberton is also no longer handling cases related to the girl’s case. The behavior of the prosecutor is investigated by the Public Prosecutor’s Office and the CNMP (National Council of the State Ministry).

On the other hand, the CRM/SC (Regional Medical Council) is investigating the behavior of hospital medical staff who refused to abort a child.
