Work in the southern part of Praia Brava, in Itajai, on the north coast of Santa Catarina, had to be stopped because they were being built on sea land. The judge’s decision ordering the immediate stop belongs to Judge Jurandi Borges Pinheiro of the 2nd Itajai Federal Court and was issued on Friday (8).

A public civil action by the MPF (Federal Public Ministry), a study by the SPU (Union Heritage Supervision) showed that the site is entirely on sea land. Defendant would have mischaracterized the site by removing native vegetation and leaving only the exotic. Also, according to the MPF, the issued permit would violate municipal and federal laws.
“I understand that the reasons given by the ministerial body are quite plausible in the sense that the property of this requirement, a residential property currently under construction, completely covers the sea area, therefore, of permanent preservation,” the judge said. .

According to the judge, even though other residential developments have done the same, since “the degradation of the original nature of this space, such situations are not enough to ignore areas of permanent conservation either from the community, much less from the state authorities,” concludes .
After an injunction is issued, the defendant must place a sign in front of the building stating that there is a lawsuit. The fine for non-compliance is 2,000 reais per day. Appeals can be made to TRF4 (Federal District Court for the 4th Circuit) in Porto Alegre.
