The public prosecutor’s office in Madrid demanded eight years and six months in prison for a young man who attacked a nurse on the subway after an argument over wearing a mask incorrectly.

The public prosecutor’s office in Madrid said this Friday that a spokesman for the public ministry accuses him of bodily harm and seeks compensation for civil liability for 80 383 euros because the victim lost right eye vision.

Events happened July 13 last year in a subway car on line 1, on the route between Cuatro Caminos and Alto del Arenal stations, when the victim, a nurse by profession, repeatedly demanded that the defendant put on the mask “correctly”, given that he wore it at chin level without covering it nose and mouth.

Other passengers joined in the protest, despite the fact that the defendant “repeatedly” refused to properly wear a mask. This was done by the nurse herself, and an argument broke out between them, in which they kicked and punched each other until they were separated by other users.

A few seconds later, as soon as the car stopped at the Alto del Arenal stop, the defendant, “with the intent to undermine the physical integrity” of the victim, hit him in the eye with the edge of the mobile phone he was carrying, while using his hand. scream asshole, I hope you die” and then ran away.

According to the prosecutor’s office, as a result of the attack, the victim lost the sight of his right eye, and the eye complications he has “suggest non-pecuniary damage due to a slight loss of quality of life.”

For this reason, the public ministry requires eight years and six months in prison for the accused, who was arrested on July 19, 2021 and has been in temporary detention since July 21, 2021.

On account of the alleged aggressor, several robberies and careless thefts, crimes against property and lawsuits in the Balearic Islands.

The prosecutor’s office also recalls that the accused, a citizen of Colombia, “did not present any documents allowing him to remain in Spain”, as well as “the presence of any reasons justifying his stay in Spain.”
