An 11-year-old girl who became pregnant after being raped had an abortion this Wednesday night (22) in Florianopolis. The information was confirmed by the MPF (Federal Public Ministry).

On the same day, the agency issued a recommendation to the University Hospital Polidoro Hernani de San Tiago UFSC (Federal University of Santa Catarina) to guarantee abortion in cases similar to child rape in the state.

The hospital had until noon this Thursday (23) to respond to the MPF. The federal agency said this afternoon that HU has partially accepted the recommendation.

According to the SMP, “the hospital notified the prosecutor’s office within the prescribed period that the patient and her legal representative had been contacted and taken steps to terminate the child’s pregnancy.”

There is no word yet on the girl’s condition. She was 29 weeks pregnant. The MPF clarified that the hospital only accepted the recommendation on a case-by-case basis.

Regarding the other terms of the recommendation, HU informed the MPF that the measures to be taken by the Attorney General would be evaluated.

At first, the hospital refused to perform an abortion on a girl who was admitted to the ward at the 22nd week of pregnancy. The medical team argued that the procedure is carried out without the consent of the court only until the 20th week.

The HU-UFSC note states that it does not share information about the procedures performed in the hospital regarding the confidentiality of information and patient privacy. He also added that demonstrations were not possible at the moment, as the case of the pregnant girl was being handled under judicial secrecy.

Alesc (Legislative Assembly of Santa Catarina) published a memo in the case of a child who became pregnant. The Assembly emphasized that the performance of abortion in court cases is not subject to judicial authorization.

“In this case, the pregnancy is not only the result of sexual abuse, but also poses a risk to the life of the pregnant woman, who is a child who has just turned 11 years old. Thus, when she arrived at the medical unit, the girl was subjected to new violence – the imposition of an obstacle that has no legal support. By going to court, the child and his mother once again violated their rights,” the text says.

The institution deemed the hearing at which the child was introduced in Tijukas County “absolutely violent, in which the representatives of the justice system convinced him that they should protect her, keep the pregnancy and give the child up for adoption.”

And he continues: “By resorting to the healthcare system and the justice system to protect her rights, the girl was subjected to even more violence. She again became a victim of those who were supposed to protect her.

According to Alesk, similar situations continue to happen to girls and women, not only in Santa Catarina, but throughout Brazil.

Finally, it says that it rejects “any and all acts that constitute institutionalized violence against women and girls in Santa Catarina” and calls for an urgent investigation into the facts so that such incidents do not happen again.
