For ignoring the instructions of the mother of the detainee, who a few days later committed suicide in the UPA (Forward Prison) in Ituporanga, the state was convicted and will have to pay a fine.
The PGE (Santa Catarina Attorney General) said it is evaluating the decision and any appeal will be offered within the court time limit.
The mother of a medical student informed the UPA authorities about the young woman’s mental state. He waved his hand at the need for medication.
A few days later, the prisoner was placed alone in a cell due to the anti-Covid-19 policy in place at the time. The next morning she committed suicide.
The episode took place on January 23, 2021 in a cell. A young woman committed suicide with a bath towel tied to the bathroom window. She had just finished breakfast, shortly before noon.
Diagnosis of a psychological disorder
The biomedical student recently graduated from college in Blumenau. The decision was made after a diagnosis of depression and bipolar (schizoaffective) disorder. Soon after, she was involved in a robbery of a business and was arrested red-handed.
The mother, knowing about the state of mental health of the young woman, immediately contacted the prison department. She alerted the authorities to the need for ongoing treatment, but was told to return home. He heard that he needed reports, prescriptions and necessary medicines.

A few days later, at dawn, the girl was transferred to the Ituporanga cell block, where she was found lifeless.
More than a year later, the State is condemned
The verdict came more than a year later. She is from the 3rd Board of Appeal of the Judiciary of Santa Catarina signed by Judge Alexandre Morais da Rosa.
The administration tried to claim that the student’s health condition was not transmitted to the prison servers. He also stated that stopping the drug the girl was taking for less than 12 hours could not be considered grounds for a registered suicide.
The judiciary responded.
“The state is one, with different agencies, so an omission in the management of information about people with mental disorders or disabilities entails the responsibility of the organization for a specific omission,” explained Judge Alexandre Morais da Rosa.
For him, it was proved that the young woman needed support, a fact of awareness of the health network, but left aside by another government agency.
