This is the position taken by the civil court of Rome in response to an appeal by two mothers of a minor girl who, in September 2019, requested the issuance of an electronic identity card valid for emigration, indicating their names as “mother” and “mother” or, alternatively, with the word ” parent” for both. At the time, the municipal authorities were unable to accept the request due to a decree by former Interior Minister Matteo Salvini, which required the mandatory indication of “father” and “mother” in the fields for parents.
The associations Lenford Network and Rainbow Families filed an appeal by the two mothers, securing that the mayor of Rome, Roberto Gualtieri, be required to indicate in the documents the neutral qualification of the “parent” according to the names of the two applicants. This was already the case from 2015 until the beginning of 2919 with the introduction of the Salvini order, who, in fact, tweeted about his disappointment with the decision of the judge. “Using the words ‘father’ and ‘mother’ (the most beautiful words in the world) on your ID card (the most beautiful words in the world) would, according to the Civil Court of Rome, be in violation of the EU and international standards.” , wrote the current Minister of Infrastructure and Transport, “hence the decision to replace them with the more neutral word ‘parent’. Are the words ‘mom’ and ‘dad’ illegal or discriminatory? I have no words but really.”
The sentence is clear: “A document that indicates, on the basis of a birth certificate, that a minor is the daughter of a particular woman and adopted by another woman, one of the two women is indicated as “father.” , contains a modified and, therefore, false representation of reality and combines the essential details of the crime of ideological forgery committed by an official in a public act. However, this is only the first step. “Unfortunately, the government has not yet canceled the decision”, – explained the lawyer of the two mothers, Vincenzo Miri, – in this way, he still continues to insult the dignity and personality of many families who, from time to time, must ask the court to repeal the “Decree of Salvini” in order to recognize their fundamental rights. Palazzo Chigi announced, that this issue will soon be considered by the government with special attention.
