Three candidates, two at the federal level and one at the state level, from Santa Catarina had to change their urn names in order to be approved by the PRSC (Procuradoria da República de SC). They used “Bolsonaro” or “Lula” as the surnames of presidential candidates, a legal practice subject to proof that the person was known in this way.
The PRSC invited applicants to provide explanations regarding the use of the name in order to prove the person’s connection to the name. At the same time, the defense of the candidate for the vacancy of the State Department, who used the name “Bolsonaro”, was justified.
“He is completely connected with his personality, since he has been using this name since 2015 on social networks (Facebook, Instagram, Youtube) and in the community in which he lives,” the defense wrote.
In the decision, signed by Deputy District Attorney for Elections Claudio Valentinim Cristani, the PRSC wrote that the law allows a candidate to compete with the nickname or name by which he is best known if there is no doubt about his identity. , he does not violate modesty, is not funny or irreverent.
“In this case, although there is evidence that the candidate is known on his social networks under the nickname that he intends to use as the name of the urn, it appears that in addition to the fact that he only recently took a sedative, since until 2021 he was in social network with his baptismal name, the alleged ballot box name could raise doubts about his identity, as well as generate undue electoral dividends in his favor, with the potential to cause an imbalance between controversial candidates,” the PRSC reasoned in action.
For the prosecutor’s office, the indication of the last name in the electronic ballot box serves the interests of not only the candidate, but also the voter, who cannot have any doubts about the identity of the elected candidate, and the election commission. Justice itself.
Candidates have already been evaluated in the process and the same conclusion: the candidacy is postponed, but the name on the ballot box must be the name of the individual.
“The Regional Electoral Prosecutor’s Office, through its signing proxy, expresses its approval of this KIR (Candidature Registration), which must be registered in the box with the name and surname contained in the registration application, since it does not indicate any other nominal option,” concluded the election justice in two out of three actions.
