The court ruled that the Union must supply the breast cancer drug Palbociclib to municipalities in the north of Santa Catarina. The decision of the 2nd Federal Court of Joinville was published this Monday (18) in response to a public civil lawsuit by the MPF (Federal Ministry of Public Affairs).
According to Anvisa (National Health Surveillance Agency), each box of medicine with 21 capsules costs R$ 18,900 in direct sales. The cost of the medicine for sale to the government is R$11,100.
“Faced with this scenario, despite the fact that palbociclib has been officially included for the treatment of HR+ and HER2- advanced metastatic breast cancer, the supply of the drug has been virtually blocked by the Union as the resources it has provided make it unfeasible. issued by medical institutions,” said Judge Paulo Cristován de Araujo Silva Filho.
The Union has a month to start distributing the medicine
In total, nine cities are subject to the decision: Araquari, Balneário Barra do Sul, Barra Velha, Campo Alegre, Garuva, Itapoa, Joinville, São Francisco do Sul and São João do Itapério.
The Union has 30 days to comply with the decision, which will remain in effect until the diagnostic guidelines for the treatment of the disease are updated and a special authorization is created to allow the hospital to reimburse the government for the sale price.
